Halloran-related Federal Case Refiled

San Francisco July 30, 2004--Kevin Gage, Thomas Kikuchi and Stephanie Landa have refiled their case in Federal Court this week.  They were sentenced to 41 months in prison followed by three years supervised probation one year ago today

They are pleading entrapment by estoppel, meaning that they are claiming that Inspector Halloran entrapped them at the March 11, 2002 LAMPS [League of American Marijuana Patients] meeting in which the SFPD Capt Cashman and Inspector Halloran made several assertions about getting a permit for growing and other medical cannabis guidelines.

Halloran turned their case over to the Feds after Captain Cashman had seen their physician's statements and had verified that garden was medical and signed off.

Captain Kevin Cashman was later transferred from the Narcotics Division to Northern Station over the case while Inspector Marty Halloran was promoted to Sergeant.
