DR. GREEN SUES WEEDTRACKER
Asks $10,000 for Defamation

Los Angeles, CA Oct 24, 2006 -- CA-Envelope-pushing medical marijuana distributor Richard Sentz, also known as Dr. Green, has threatened the dispensary review site Weedtracker with a lawsuit for allegedly posting defamatory statements about his business, according to an email sent on 9-11-'06. The "demand letter" sent by attorney James Anthony requests that Weedtracker pay $10,000 to Mr. Sentz, remove all defamatory statements about Sentz, and reinstate his membership with the forum-based website.

Here is an excerpt from a letter Richard Sentz sent to Jon Furry, founder of Weedtracker:

"I have a legal business in the state of California and you are allowing negative remarks to be posted in your newspaper or as you call it, News and Reviews web site...This has a negative effect on my legal business in California and you will not recognize or correct this abuse..You are going to put me in a situation that I have to ask the courts for relief, be it in an 90 day Injunction or straight claim for damages..."

Jon's reply, August 23rd, 2006:

"I dont want to talk to you. I already told you I would refund your (advertising) money on 8/29/06 as we don't have any money right now to pay you with. Your going to need to direct all future communications to our attorney: Matthew L. Kabak : mattkabak@mattkabak.com."

Towards the end of August, 2006, Sentz was banned from posting on Weedtracker, and all of his prior posts were removed. In their place were dozens of entries, some of them by Weedtracker administrators, belittling Sentz.

A separate website, http://www.onlinepot.org also published negative rants against Sentz. However, there were no credible allegations made, just a lot of hyperbole calling Sentz a "scammer" without backing it up. And at press time, everything OLP publisher Chris Kenoyer wrote about Sentz had been removed from the website. Kenoyer does provide a link to another site that libels Sentz as a scammer, again with no evidence. http://scams.da.ru A disclaimer regarding the scam site is posted: "Not Run By OLP..."

On September 1st, 2006, this letter was sent to Jon Furry and Chris Kenoyer:

"James Anthony, Counselor and Attorney at Law, mmdlandUseLaw@comcast.net,
Oakland, CA will be in contact with your attorney Matthew L. Kabak, with a "Demand Letter".

www.Onlinepot.org owner, Chris Kenoyer will be getting a "Cease and Desist Order" from the courts. Since Mr Kenoyer is in hiding, according to his posts on Marihemp, the order will be sent out to all the various Search Engines, some 1500 of them and his web site, will in effect be removed from the Internet.

The expense of legal fees is usually awarded or can be awarded to the winning party. Please pay close attention to the "Demand Letter" and what is requested of you and your web site, WeedTracker. My Kenoyer has destroyed his own web site or effectively removed it from the Internet, via his illegal and misrepresentation. Please do not let this happen to WeedTracker.

The subsequent letter was sent on 9-11-'06 to an ad-hoc group of activists and pot people, including Rebecca Saltzman, Field Coordinator for American for Safe Access to Medical Marijuana. It was titled, "DAMAGES ARE $5k PER DAY...GUESS I OWN WT"

"Dear Mr. Kabak:

This is a demand letter requiring that your client, WeedTracker remove all statements defaming my client, Dr. Green, from its website, reinstate his membership and advertising, and pay $10,000 in compensation to settle this matter.

I am stunned that your client would so obviously leave itself open to liability for defamation, tortious interference with business relations, and a B&P 17200, among other causes of action. Dr. Green is not a public figure. And not only the members of WeedTracker, but two of its administrators, have falsely alleged facts, not opinion, that clearly defame my client. What were they thinking? I can only assume that they have pursued this course without advice of counsel.

Both of our clients are part of the medical marijuana movement. One might prefer not to see litigation within the fold, so to speak. But perhaps it is an indication of the maturity of the movement that such disputes now arise formally.

Dr. Greens demand will increase after the complaint is filed. Please contact me before September 25 to avoid that necessity.

According to Richard Sentz: "I gave WeedTracker a $500 donation and about 10 days later they banned me, so I ask for it back and they refused....hence the legal (battle) started. They refunded the money prior to filing of the lawsuit but it took the lawsuit or "Demand Letter" to get them to remove all their negative postings about me."

From Weedtracker's posted rules: "Posts that...contain material that is knowingly defamatory...should not be posted."
